In one of his first actions as president, Barack Obama has called for Guantanamo Bay to be closed. This proves that a new era and a new direction for America has begun. However, is this the right decision?

Obama has been true to his word.
This was one of Obama's key promises. Within his first few hours of taking office, he halted all Military trials. He obviously places the utmost importance on this matter. He said he would shut it down and so there have been no surprises. He is doing as he said he would.As President, Obama has complete authority to do so and as the public were aware of his intentions, he really should not be critiqued.
Does this signify that Obama intends to keep all his promises? Whilst commmendable the practicalities have to be thought through. Is one year a realistic deadline? What will be the consequences of such action? Theory and practicality rarely equal eachother.

Some detainees have already found new homes
It has already been decided that "17 Chinese Uighurs... will not face charges...and Uighur communities in the States are willing to accomodate them" . (D Orr, 'Obama is right to tread warily over Guantanamo Bay' http://www.independent.co.uk/opinion/commentators/deborah-orr/deborah-orr-obama-is-right-to-tread-warily-over-guantanamo-bay-1488577.html, accessed on 22.01.2009). This is a positive outcome for some prisoners. If returning to their home country is not an option then rehabilitating them into communities where they are likely to adapt well seems like a happy ending to a grim tale.
Utilitarianism should prevail. Arguably, citizens may not be happy to allow dangerous criminals into their communities. The disruption to settled communities should be weighed in balance with the ability of these newcomers to integrate into a country within which they have been subjected to inhumane treatment. Mal-effects should be anticipated.

It is about time.
This disgusting treatment of human beings should never have been allowed in the first place. Yes, the detainees may have committed atrocities but an eye for an eye does not work out. Five detainees have died whilst in Guantanamo Bay. The treatment given to detainees has been widely frowned upon. It would not have been morally right to allow this treatment to continue. In the light of the modern world, with its emphasis on equality and human rights, this sort of behaviour can not continue. Obama is right to disassociate his new Obama-Biden administration from such disrespect for human morals.
Obama has been given the opportunity to address the wrongs committed by Bush and he is embracing it. The longer this prison is allowed to remain working, the harder it will be to shut it down. Therefore Obama has to do the right thing as early as possible. This is how he has chosen to address his responsibility. Those who support him should be proud.

Federal trials are more effective than military trials.
"Federal trial has proved far more efficient in dealing with terrorists than the military trials that have now been suspended" (2. ibid at 1). This statement speaks for itself. There was no need for inhumain torture or bad treatment of detainees. Those detainees still thought to be a threat will be tried in US Federal trials rather than the Military ones at Guantanamo Bay which gave supreme power to the military. Federal trial upholds the idea of separation of powers so that the military does not exert too much power or influence and it is leashed. This only seems fair. After all, there are many murderers and perhaps even, equally as culpable criminals who are put on trial throughout the world. These detainees should be givent the same treatment as others.
Federal trials are a lot fairer than Military trials but this does not mean that they are more efficient. Clearly, the treatment given to detainees resulted in large amounts of stress being put upon them. Obtaining evidence in this manner will probably mean that the evidence will not stand in US Federal Courts because it is not reliable. Coercion amongst the other tactics used to draw out evidence from the detainees, may have resulted in false confessions and information but this information is of no use in a Court of law. If no evidence can be obtained as to the culpability of the detainees in their individual trials then they may be released. The question to be asked is, is this right for the greater good?

Such an atrocity would not be permitted to exist in Europe.
The idea behing Guantanamo Bay is completely out of line with the Euroean Convention on Human Rights. For example, the unlawful detention of people would breach it as would would inhumane treatment. Therefore it is wrong for such an establishment to exist within America. Obama should not have to carry on Bush's mistakes. Obviously America is not bound by the European Convention but America should know better. It is morally wrong on all levels to allow the existence of such a place.
This point is clearly weak. America is not inside Europe and so should not be judged by international conventions that do not bind it. Different people have different morals and so it appears the same with continents. Guantanamo is one atrocity that has occured in the modern world but there are many more such as the situation in Zimbabwe.

New presidency. New image.
As proved by the recent Gaza conflict, the only way to deal with international disputes is to act diplomatically. The military has an important role when needed but it does not mean that the role of the military should overspill into other areas. As such, this is the right plan of action to take in order to redress the problems associated with Guantanamo and Bush. By shutting down Guantanamo Bay, Obama is making a statement. His presidency will be much more different than Bush's. This is the right approach to take in order to repair America's relations with the middle East.
Arguably, a complete polar opposite change in approach may not always be a good thing. Not only is there a problem with practical implementation of contrasting proposals but also such a complete change may have a negative effect on many people. If American society has been geared towards Bush's perspective then it will be a hard change for society to accept new and radical proposals. For the staff employed in Guantanamo, it will be impossibleto find a similar day job! What will the effects be on these military soldiers employed to guard Guantanamo? Will there be any psychological effects? Indeed, change should be gradual not sudden in order for it to be sustained.

Great role model.
There can be no doubt that Obama was a very popular choice for President. By wanting to close Guantanamo within the year, he is showing outstanding ambition. By doing so he aims to uphold his morals. As such, he should be celebrated as one of the best role models of our time. He has a professional attitude and he is continuing along the same business. i.e. he is continuing to fight terrorism. However he plans to do it whilst sticking to his morals. This determination is something that American's along with others can aspire to be like.
There is only one post for Pesident available. If Obama does become a role model there will be many disappointed children out there! Obama did not get to where he is with a snap of his fingers. He worked hard at his education and became a lawyer. However, his privilege will not be available for everyone so why give people false hope?

This is a can of worms
Money seems to be the concern on mosr peoples minds nowerdays. However cost should not be an issue here. Addressing the need to uphold human rights is the main issue. President bama must be aware of the task ahead of him; costs, administration, relocation and consequences. If he didnt feel so confident in his ability surely he would have left this atrocity to become worse. Then of course, he would face deep criticism. Howevr, he chose to address the task and should be applauded.
It is not just a case of signing papers and ordering release. President Obama has a hard task ahead of him. Different prisoners will have to be located in different areas. Some will have to go through Federal trals others may be rehabilitated in America or other countries. Some will have to be kept safe away from their homelands. Rehabilitation will also be expensive of course. Amidst a recession there is no spare cash flowing around.

The US made this mistake so the US can clear it up!
One of the continuing statements read out by Gordon Brown throughout his various press meetings regarding the recession is that countries have to work together internationally. Although, this is clearly a different kettle of fish, the same phrase applies here. Terrorism has not only affected America but Britain also. Mr Bush set up the detention centre in line with his "war on terror". As such, countries around the world should work together to integrate the detainees intot heir countries if they can not return to their own. Indeed, Australia is one of the countries that has given its permission to accept detainees.
One of the solutions proposed it that other countries will adopt some detainees. However, these are not normal detainees that can be rehabilitated into society. They have been imprisoned in Guantanamo Bay because they are suspected to be highly dangerous people. In Guantanamo they are controlled. However, releasing these higly dangerous individuals and then dispersing them throughout different countries is not the ideal solution.

Releasing the prisoners is not enough.
Releasing those who are cleared for release is a decision belonging to the Obama-Biden administration. The pressing matter is to release them and post release care can be considered after. Arguably, if the detainees are being relocated to foreign countries it is their choice whether or not and how to help the detainees. President Obama is the man in charge but he is only two days into his presidency and already great decisions are being made. Surely many more right and complete decisions will be delivered soon.
The effects of the unhumain torture such as water boarding, physical abuse and the like will have had terrible effects on the minds of these individuals. Releasing them whilst unknowing whether their minds are stable is not an ideal solution. Who knows, they may even be more dangerous now then they were before they were detained. Granting them their freedom in such unstable minds may not be a good idea. Perhaps follow up counselling to determine their mental states is advisable?
