DEBATE: SHOULD THE GURKHAS BE GRANTED THE RIGHT TO SETTLE IN THE UK?

The Gurkha infantrymen have always held a special place in the hearts of members of the British army. They are notorious especially amongst those who have witnessed their tenacity, unstinting loyalty, strength, and valour. Amongst them, they have received 13 Victoria crosses. The Gurkhas were hand picked 200 years ago by British colonizers in Asia who recognized them as a unique warrior “caste,” ideal candidates to assist the British in the expansion of its colonies as combatants and peace-keepers in conflicts spanning the globe. Hundreds of thousands of these men who hail from the base of the Nepal-Tibet have sacrificed their lives for Queen and country. Indeed it has been said that if we had to hold a minute’s silence for every Gurkha who perished in WWII, we would be silent for two weeks. The 2,000 or so Gurkhas who are now seeking the right to settle in the UK did not move to the UK in 1997 when Hong Kong became independent of the UK. This fact has led some senior members of the judiciary to conclude that this means that they therefore do not have sufficient ties in Britain to entitle them to settle here. The men that did move over here post-1997 have been granted indefinite leave to remain. Five ex-servicemen are challenging the government’s denial of their right to reside here. They are supported by the Gurkhas who were granted indefinite leave to remain, including two recipients of the Victoria Cross. The servicemen and their supporters are incensed at the treatment of their brethren who risked life and limb to defend and attack to uphold the integrity and sovereignty of this country. So do they have the right to settle in the UK?

They already abide by our laws so should be treated as citizens


Under international law, Gurkhas are not mercenaries but fully integrated soldiers of the British army and abide under all the same rules and regulations that British soldiers serve. Therefore they should be entitled to be treated as British citizens, especially as they have displayed complete loyalty to this country and sacrificed their lives in defence of it. However, as others have siad this totally goes against the anti imigration policy. What I find is the case here that in this extreme case it should be allowed that the Gurkhas be allowed to settle in the UK but they should be told to find jobs as well so that they aren't spongeing off the government & respect the cultures that are already settled in the UK. It should also be brought about that the quantity of illegals in the UK be fully reckognised & those that dont have the right to stay in the UK be deported

Gurkhas have been described as the “bravest of the brave” on the battlefield. They can be credited with helping this country win many wars abroad as they understand the terrain, mentality, and military tactics of enemy soldiers and guerrillas in the East better than British soldiers in places like Afghanistan, Iran, and Singapore. Therefore they are unique foreign soldiers in the British army.

Legal reasons not to allow them are weak


The use of sufficient ties as a legal rationale to exclude or include an individual from leave to remain is a weak and hypocritical argument. For example, many recent immigrants like Russian oligarchs and other Eastern Europeans do not have sufficient ties to this country and certainly have not defended the country in the manner that the Gurkhas have yet they can immigrate here with impunity.

The UK government is trying to stem the tide of immigration to this country after the revelation that the UK is predicted to be the most populous EU country in the next 30 years despite the relatively small size of the island. Allowing any more groups of immigrants and their families is against government policy.
